1. About These Terms
These Driver Terms of Use govern your access to and use of the ProTow driver software, Driver Console, dispatch tools, job information, communications features, media features, invoicing functions and related services.
ProTow provides software used by towing and roadside-assistance businesses for dispatch, driver operations, customer communications, job management, media, invoicing and related business functions.
Before you first use the Driver Console, and again after any material change to these Terms or the ProTow Privacy Policy, ProTow asks you to confirm that you have read and agree to these Terms and have read the ProTow Privacy Policy. ProTow records which versions you confirmed and when.
If you do not agree to these Terms, you must not use the Driver Console.
2. Your Relationship With Your Towing Company
The towing or roadside-assistance company that authorized your ProTow account is referred to in these Terms as your Company.
ProTow provides software to your Company. ProTow is not your employer and does not independently provide towing or roadside-assistance services.
Your Company remains responsible for its drivers, vehicles, equipment, customer service, pricing, towing procedures, safety practices, licensing, insurance, employment or contractor relationships, and compliance with applicable laws and regulations.
3. Authorized Driver Accounts
Your Driver account is intended for your authorized use.
You agree to provide accurate information, protect access to your account and device, and not knowingly permit another person to use your account without authorization.
You must promptly notify your Company or ProTow if you believe your account or device has been compromised.
You may use ProTow only for legitimate work authorized by your Company.
You stay signed in on your device while you keep using the Driver Console. Your sign-in ends when you sign out, when your access is removed or revoked, when your Company's ProTow account is suspended or cancelled, or after 30 days without use.
4. Driver Safety
ProTow is an operational tool and must not interfere with safe driving.
Do not interact with ProTow while driving when doing so would be unsafe or unlawful.
You are responsible for complying with applicable distracted-driving, traffic, towing, workplace-safety and equipment requirements.
ProTow does not replace your professional judgment, training, Company procedures or legal obligations.
5. Dispatch and Job Information
ProTow may provide job information including customer contact information, pickup and destination information, service type, vehicle information, notes, media, location information, dispatch status and invoice information.
You may use customer and job information only as reasonably necessary to perform authorized towing or roadside-assistance work and related Company duties.
You may not sell, disclose, copy, retain or otherwise use customer or job information for unrelated purposes.
6. Location Information
When location is collected:
- The Driver Console collects your device's location automatically when your driver status is On Duty, Active, Assigned, En Route, On Scene or In Tow.
- It does not ask for your location when your status is Off Duty or Inactive.
- Location is collected only while the Driver Console is open and visible on your screen, and only if your device and browser allow ProTow to use your location.
How your location is determined:
- ProTow asks your browser for your location through the browser's standard location service. Your device decides how to work it out, which may use GPS, Wi-Fi or mobile-network information.
- ProTow does not determine your location from text messages.
Automatic updates and limits:
- While the Driver Console is open and on your screen, it asks for an updated location about once a minute.
- Where your device and browser permit, it also tries again when your internet connection returns, when the Driver Console comes back onto your screen (for example after you unlock your phone, switch back to it, return to it with the Back button, or open it from a ProTow notification), and when you allow location access.
- Your location may not be updated while the Driver Console is hidden, in the background or closed, while your phone is locked, or when your device cannot obtain a location or has no connection. ProTow does not promise continuous location collection.
What ProTow stores and how it is used:
- ProTow stores only your most recent location: the coordinates, the accuracy your device reported and the time your device captured it. Each new location replaces the previous one, and ProTow does not keep a history of your movements.
- ProTow uses your location to support dispatch and to estimate distance and travel time. It may use your current or last-known location to rank you against other drivers who are otherwise eligible for a job. How recent and how accurate a location is affects how much weight it gets; an old or imprecise location does not, by itself, make you ineligible. Eligibility also depends on other factors, such as your driver status, your truck and the service needed.
- To estimate road travel time, ProTow may send your coordinates and the job's pickup location to Google Maps Platform.
- When you mark a job En Route, the Driver Console uses your location to estimate when you will arrive. ProTow may text the customer that estimate together with the job reference. The text does not include your location.
- Your latest location stays stored until a newer location replaces it or your driver record is removed.
Your Company may also have its own policies about employee or contractor location information. Those Company policies are separate from these Terms.
7. Photos, Video and Other Media
ProTow may allow drivers, customers and authorized Company users to capture or provide job-related photographs, short videos and other media.
You agree to capture or use media only when reasonably related to an authorized job or legitimate Company purpose.
Do not intentionally capture unrelated private information, unlawful material or content that is unnecessary for the job.
Job-related media may be used for documentation, invoicing, customer service, claims, insurance, legal, compliance or dispute-resolution purposes.
How long media is kept:
- Job photos and videos, including those customers upload through a job's photo link, are kept for about seven years after upload and are then automatically deleted from storage.
- Customer signatures and scrap-vehicle photos are kept for seven years, unless a longer period is legally required.
- These periods are ProTow's retention policy. The rest of the job record is not deleted when a photo or video expires.
Deleting media:
- You can permanently delete photos or videos that you uploaded to a job you are authorized to work on. You cannot delete media that customers or other people uploaded.
- Your Company can permanently delete an archived job, together with its media, only when the job is at least seven years old and has no invoice.
8. Customer Signatures
ProTow may allow you to obtain customer or authorized-recipient signatures.
You must not falsify, alter, fabricate or submit a signature without authorization.
A signature captured through ProTow may become part of the job or invoice record and may be used for business, legal, insurance, accounting, payment or dispute-resolution purposes. Signatures are kept for seven years, unless a longer period is legally required.
9. Invoices
Where enabled, ProTow may assist your Company with preparing invoices, recording services, distance, time, additional charges, discounts, taxes, customer information, signatures and payment status.
You are responsible for entering information accurately to the extent required by your role.
Your Company remains responsible for its prices, taxes, billing practices, refunds, payment policies, customer disputes and compliance with applicable law.
ProTow is not the towing-service provider merely because its software is used to prepare, manage or deliver an invoice.
10. Communications
ProTow may facilitate operational communications involving drivers, Companies, customers, telecommunications providers, SMS providers, voice systems and other service providers.
You agree to use communication features only for legitimate operational purposes.
You may not use ProTow to send harassment, threats, spam, fraudulent communications or unlawful messages.
Carrier, messaging or data charges imposed by your service provider may apply.
Job Alerts (push notifications) are optional, and you can turn them on or off in the Driver Console. A Job Alert shows only your Company's name, the service type and the job reference. It never shows a customer's name, phone number, pickup address or destination.
11. Automated and AI-Assisted Features
Some ProTow features use automation or artificial intelligence to assist with functions including telephone call handling, information gathering, interpretation of caller-provided information, classification, dispatch and other operational functions.
Automated outputs may occasionally be incomplete or incorrect.
Drivers and Companies remain responsible for reviewing information when circumstances require human judgment, particularly when safety, vehicle handling, towing equipment, customer instructions or legal obligations are involved.
12. Prohibited Use
You may not use ProTow to:
- gain unauthorized access to systems, accounts or information;
- interfere with or disrupt the service;
- introduce malicious software or code;
- impersonate another person;
- falsify job, invoice, signature or operational records;
- misuse customer, driver or Company information;
- circumvent authentication, tenant isolation, security or access controls;
- scrape or extract data without authorization;
- use ProTow for unlawful, fraudulent or abusive activity; or
- assist another person in doing any of the above.
13. Intellectual Property and Restrictions
The ProTow software, source code, object code, user interfaces, workflows, screen layouts, visual designs, branding, logos, documentation, business logic, database structures, product features, processes and other proprietary materials are owned by ProTow or its licensors and are protected by applicable intellectual-property and other laws.
Your right to use ProTow is limited to authorized use of the service through your Company.
Except where applicable law expressly permits otherwise, you may not copy, reproduce, modify, distribute, publish, sell, license, sublicense, create derivative works from, reverse engineer, decompile, disassemble, scrape, extract, replicate, imitate or use any portion of ProTow to develop, train, improve or operate a competing or substantially similar product or service.
You may not systematically photograph, screen-record, capture, reproduce or distribute ProTow screens, workflows, designs, documentation or proprietary functionality for commercial, competitive or product-development purposes.
Nothing in these Terms transfers ownership of ProTow or any related intellectual property to you or your Company.
14. Third-Party Services
ProTow relies on third-party technology providers for certain functions, which may include cloud hosting, authentication, storage, telecommunications, messaging, artificial intelligence, voice services, maps, geocoding and other infrastructure.
Third-party services may occasionally experience interruptions, latency or other issues outside ProTow's control.
Some third-party functionality may also be subject to applicable third-party terms.
15. Availability and Changes to the Service
ProTow may maintain, update, improve, replace, suspend or modify features from time to time.
ProTow does not guarantee uninterrupted or error-free operation.
Where reasonably possible, ProTow will design changes to protect active operational workflows and stored business records.
16. Suspension or Termination
Your access may be suspended or terminated by your Company or by ProTow where reasonably necessary because:
- your authorization has ended;
- your account presents a security risk;
- you materially violate these Terms;
- your use is unlawful or abusive; or
- continued access could harm users, customers, Companies or the service.
Your access also ends while your Company's ProTow account is suspended or cancelled. During that time, ProTow does not send you dispatch assignments, reminders or Job Alerts for that Company. If your Company's account is later reactivated, you must sign in again; sign-ins from before the suspension or cancellation do not resume.
If your Company removes you:
- your access ends immediately;
- ProTow deletes your driver record, including your latest location and your Job Alert subscriptions;
- any active jobs assigned to you go back to your Company for reassignment;
- job and invoice records keep the details your Company needs for its records, such as your name and the truck recorded on past jobs;
- your account with ProTow's sign-in provider is deleted after a 90-day recovery period, unless it must be kept for a legal reason or is still needed for another active ProTow role; and
- the record of your acceptance of these Terms is kept for seven years after you leave.
17. Service Disclaimer
ProTow is provided as a software service.
To the extent permitted by applicable law, ProTow does not guarantee that the service will always be available, uninterrupted, error-free or appropriate for every towing circumstance.
Nothing in these Terms excludes rights or protections that cannot legally be excluded.
18. Responsibility for Towing Operations
ProTow is not responsible for towing operations performed by your Company or its drivers, including vehicle handling, equipment selection, towing technique, roadside procedures, damage caused during towing operations, workplace conduct, employment matters, driver licensing, regulatory compliance or decisions made independently by your Company or its personnel.
19. Privacy
Your use of ProTow is subject to the ProTow Privacy Policy, which explains how personal information is collected, used, disclosed, retained and protected.
20. Changes to These Terms
ProTow may update these Terms as the service or applicable requirements change. The current Terms display their version and effective date.
If ProTow makes a material change to these Terms or the ProTow Privacy Policy, it will ask you to review and accept the updated version before you continue using the Driver Console, and it records which versions you accepted and when.
21. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, except where mandatory law that applies to you provides otherwise.
